With the rapid development of the Internet technology,Internet technology has begun to infiltrate into all aspects of society and life,and has spawned many new platforms.One of the representative ones is that Internet technology has penetrated the traditional industry and produced a new type of platform employment.The emergence of these platforms is a challenge to the traditional way of working and a challenge to the traditional form of employment.The platform employment method is very different from the traditional employment methods in both content and mode.This also means that the legal relationship identification standards applicable to traditional employment methods may not be adapted to the platform employment method.The legal relationship identification standard is the guarantee basis for laborers'rights and interests,so it is very important to apply the legal relationship identification standard for platform employment.This study takes the legal relationship of platform employment as the main research content.Firstly,it takes the theoretical viewpoint and practice of the legal relationship recognition standard of domestic and foreign platforms as the entry point of this paper,and then analyzes it through domestic and foreign practice.There are deficiencies in the model and subordination of China's platform employment legal relationship identification standards.Finally,based on the Western countries'legislative practice on platform employment,it has caused thinking about the identification system of legal relationship for domestic platforms.Combining with the characteristics of the times,it puts forward scientific and reasonable suggestions on the legal relationship identification standards applicable to traditional employment methods.It is expected that the improved legal relationship identification standards can protect the rights and interests of laborers as well as the healthy development of employment platforms.
