996 working time system,in the special circumstances stipulated by the law and the irregular working time system in the protection of workers' right to rest and other circumstances,is legitimate,but under the standard working hours system and comprehensive working hours system,it is illegal.The prevalence of this illegal work system is the product of the strategic interaction between the system itself and its participants.When overtime is common,rational workers weigh leisure costs and overtime benefits under the pressure of unemployment,and then choose to endure and accept.Under the framework of institutional environment,material environment and resources,employers adopt strategies such as manufacturing "consent" and flexible vacation adjustment,so that workers' overtime work becomes a less costly employment mode compared with increasing the number of workers.Faced with the labor conflict,the labor union is not competent to negotiate the responsibility,the labor administrative department supervision effect is not good,so that 996.ICU caused a hot discussion on the Internet.With the emergence of new employment modes formed by the grafted information Internet,there is a gap between the special working hours and the extended working hours system and the actual flexible working hours demand.Therefore,on the basis of improving laws and regulations,we should play the role of the main body of the labor law,so that we can jointly curb the 996 working time system.
