Analysis Of The Problems Existed In The Implementation Of The "Three Rights" Segregation System In Rural Contracted Areas And Its Countermeasures

In recent years,the "three-rights" division system of contracted land has been gradually implemented.How to promote the healthy operation of rural land system through the cooperation of "collective ownership","peasant household contracting rights" and "management rights" has become a problem.This article takes the specific countryside as an example to analyze the basic status quo of the operation process of the contracted land system and find out the problems that exist in it.In the aspect of collective ownership,there is the problem of privatization of collective land and strong internal and external weak of collective ownership.In terms of farmers' contracting rights,there is a problem that villagers' contracting rights are not guaranteed and are easily squeezed by operating rights;In terms of management rights,there are the issue of high operating costs and the monopoly of minority rights of operation.This paper believes that in the face of the problems existing in the implementation of the “three-rights” separation system at this stage,we need to rethink the original source and rethink what kind of functions the “three rights” should have.Different from the research related to legal scholars,the implementation of the “three-rights”separation system in the underdeveloped regions cannot individually emphasize the power of one aspect and limit other aspects.In the villages represented by Qin village,the specific implementation of the "three-power" system should strengthen the "three rights" at the same time,instead of focusing on "operational power" and neglecting "collective ownership" and "peasant household contracting rights." There are three aspects need to think.First,strengthen the governance function of ownership,Qinvillage Village Committee has many advantages in governance,and it plays an important role in maintaining the order of rural society.At the same time,to address some of its problems,it is necessary to clarify the relationship between the rights and obligations of a number of subjects and to strictly control the use of land.Second,strengthen the social security function of contracting rights,and ensure the contracting rights of farmers by optimizing the relevant rules of the second round of contracting;Third,strengthen the economic utility function of management rights,and increase the scale of new contracting.Increase support for new types of contractors to promote the development of agriculture.
