Research On Responsibilities Of Online Ride-hailing Platform In Traffic Accidents

With more people using smart phones,the internet covering larger ranges,and GPS becoming more accurate for dispatching and safety,a new service-online ride-hailing service came into being.With online ride-hailing service,booking platforms can locate passengers to reduce time spent in cruising on the road,lower taxi operating costs,and save money for passengers as well.However,in comparison with the booming online ride-hailing service,law has the time-lag effect,in this case leading to a blank on legislation.In order to guarantee the interests of passengers,ride-hailing platforms,drivers and taxi drivers,promote the legislation,it is necessary to discuss and assess the responsibilities of the online ride-hailing service providers—booking platforms.Only in this way can all parties be made sure to run under the rule of law,and the personalized development of different trades be boosted.To begin with,this thesis studies domestic and overseas on-line ride-hailing vehicles and their responsibilities,and uses the perspective of the liabilities of booking platforms,analyzes different online ride-hailed service modes,and defines different legal relationships among platforms,vehicles and passengers,and reaches a conclusion on the booking platform's responsibilities on traffic accidents and proposes the compensation standards and principles.This thesis then applies methods including literature research,legal logic analysis,comparison and case study to explore the responsibilities the booking platform should undertake on the traffic accidents.By comparison and research,this thesis found the booking platform has taken different roles in different operating modes.Where the infringement happened during the traffic accidents,there is still not consensus on how to compensate,whether or not the booking platform should take responsibilities,and if yes,how to take responsibilities.The legislature on online ride-hailing service is few except for the network booking taxi management service management procedures.In order to balance the liabilities between passengers and booking platforms,this thesis attempts to explore the standards and principles of the responsibilities the booking platform takes,for the purpose of contributing to its legal regulating.
