With the economic development and environmental problems become increasingly serious,the government's functions have been constantly changing.The traditional compulsory administrative behavior can not achieve the purpose of environmental administration,then the administrative body began to try some more gentle non-mandatory administrative behavior.Therefore,administrative incentives,administrative guidance,administrative contracts and other non-mandatory administrative behavior came into being.Among them,the administrative reward are widely used in environmental management because of the incomparable superiority and flexibility.By affirming and supporting the environmental protection behavior of administrative counterpar,environmental administrative reward can guide other environmental administrative counterparts to actively carry out certain actions to promote the realization of environmental administrative purposes.Environmental administrative reward behavior is not only can conducive to improving the efficiency of environmental administration,reduce the cost of environmental protection,but also to reduce disputes and friction,to ease the against emotions between the administrative subject and administrative counterpart.But at present our research on environmental administration reward is still in the initial stage,there are serious problems whether in the legislative or enforcement level,resulting in environmental administration awards in a large number of problems in the practice of operation,and affecting the realization of its legal effect seriously.This paper mainly uses the concept analysis method and the value analysis method to analyze the general theory of environmental administrative reward to provide the theoretical basis for the reasonable existence of environmental administrative reward.Then through the empirical analysis of environmental administrative reward in practice on the analysis of the problems.Finally,from the three aspects put forward the corresponding improvement to improve of the environmental administrative reward system.The main content structure is:Firstly,the general theory of environmental administration awards.First of,This part defines the concept of environmental administration awards,and clarifies the relationship with other environmental administrative behavior from its nature and characteristics.Than analyzes the basic theory of environmental administrative reward to prove the reasonableness of its behavior.On the basis of rationality,it further analyzes its function and value,and paves the way for the necessity of environmental administrative reward.Secondly,the problems of environmental administrative reward.Through the environmental administrative reward in the legislative status and the practice of the status quo.Then analyzing the problems to improve the environmental administrative reward system and finding a breakthrough.Thirdly,the improvement of environmental administrative reward.Suming up the above issues of the environmental administrative reward,the author puts forward that the system of environmental administrative reward should be improved mainly from the main body of environmental administrative reward,the procedure of improving environmental administrative reward and the supervision of environmental administrative reward.
