Research On Legal Issues Of Ecological Damage Assessment System

Since 80 s,along with the pace of industrialization and urbanization in China,the economy has also developed rapidly,and one of the costs is frequent environmental pollution accidents.On the one hand,environmental problems have entered a stage of large area,which is the pain brought by economic development;on the other hand,it is necessary to balance the relationship between economic development and environmental protection.Therefore,the pressure on environmental protection is unprecedented.However,the new environmental protection law and four supporting measures have brought new impetus to environmental protection.The number of environmental litigation cases has also increased,and the government and the public have increased their attention to environmental protection.However,the identification of environmental responsibility is still vague,the assessment system of environmental damage remains to be perfected,and the relief of environmental pollution is relatively blank.In general,environmental awareness and system are all progresses in all directions,but still can not adapt to the current severe environmental situation and the state's high pressure situation.Based on the legal point of view,taking ecological damage assessment as the breakthrough point,combined with the "ecological environmental damage compensation reform plan" and other laws and regulations and policies,this paper will discuss the legal problems of ecological damage assessment from the following parts.In the introduction part,we elaborated the background and significance of the topic selection,and studied the development process of ecological damage assessment at home and abroad.In the text,the first part clarifies the concept and connotation of ecological damage and ecological damage assessment,and discusses the status of legislation,policy and practice of ecological damage assessment;the second part begins with the case of typical cases and analyzes the main common problems of ecological damage assessment;The third part is to compare and analyze the foreign ecological damage assessment system,and to find the useful evaluation methods and means for reference,and the fourth part is the countermeasures and suggestions for the construction of the ecological damage assessment system in China,and find a solution according to the problems obtained above,in order to add my own opinion to the construction of the ecological damage assessment system.
