Research On Ecological Environment Relief Fund System

Ecological civilization construction is a crucial component of building a moderately prosperous society in all aspects,our country does not follow the old road of pollution,and is actively exploring new models of economic development and environmental protection.It is a new path to govern ecological problems and relief environmental public welfare by completing ecological environment relief fund in our country,and a systematic solution to problems such as unclear orientation of the rules,narrow coverage,and lack of responsibility assignment,relief nonspecific object through methods of socialization.Our country began to spread environmental civil public interest litigation recent years,pay attention to relief and preserve environmental public interest step by step.The relief fund of environment protection is a supplementary means in carrying out environmental civil public interest litigation,supports a litigation and execution of relief programme after it,assists the lunch of environmental civil public interest litigation in our country.In addition to the introduction and concluding remarks,this article mainly analyzes and demonstrates from four aspects.The first part of the article starts with the basic meaning of the eco-environmental relief fund system,and specifically elaborates the content of the ecological environment relief,ecological environment relief fund,and ecological environment relief fund system,analyzes the relationship bet-ween ecological environment relief fund system and other existing domestic ecological environment funds,elaborate the characteristics and functions of the eco-environment relief fund system,and expound significance of the fund system.The second part of the article mainly discusses the current status of existing eco-environmental fund system in our country and analyze the problems,summarizes existing system focusing on four aspects:the status of eco-environmental fund legislation,local practice,juridical practice and theoretical research,to point out the problems of existing system and origins to them.The third part of the article summarizes the existing eco-environmental fund system outside the region,comprehensively introduces the U.S.Superfund and State Working Capital Fund system,Japan's pollution compensation system,the soil and groundwater remediation fund system in Taiwan in terms of institutional background,funding sources,management models,scope of use,procedures,and governance results,and summarize the experience or lessons from the operation of the extraterritorial eco-environmental fund system,with a view to providing useful suggestions for establishment and gradual improvement of the ecological environment relief fund system in China.The fourth part of the article,guided by the environmental protection priority principle,the prevention principle,the principle of public participation,and the polluter pays principle,puts forward detailed assumptions from the establishment of an independent status fund,the standardization of internal functions of the fund,to the functional division,diversification fund sources and the establishment of fund use procedures,and finally offers proposals to concrete the supporting measures of the fund system.It is hoped that the progressive ecological environment relief fund system will promote the vigorous development of the business of China's ecological environmental public interest relief and environmental civil public interest litigation.
