Research On The Legislation Of Ecological Environment Protection In Ethnic Areas

China's ethnic areas are vast,sparsely populated and rich in natural resources,but the ecological environment is relatively fragile.Over the past 40 years of reform and opening up,China has made unparalleled social achievements,and created a Chinese speed and Chinese model in economic development.However,as a developing country,there will inevitably be contradictions--especially in underdeveloped ethnic areas--between economic development and ecological protection while pursuing high-speed in the process of modernization.There are serious soil erosion and land desertification,sharply reduced biodiversity and frequent natural disasters such as drought,floods,ice and snow,and earthquakes in these areas.The contradiction between ecological environment protection and exploitation has seriously restricted the economic and social development of ethnic areas,and also has marked impact on ecological environment protection.In the new normal economic development,it is necessary to accelerate the economic and social development speed of China's ethnic areas,while at the same time ensuring the sustainable development of social economy as the fundamental policy for China's future economic development.Law is the most important means for governing a country,and good law is the prerequisite for good governance.At present,a series of relevant laws and regulations have been successively promulgated in the field of ecological environment protection in China,especially the promulgation of Circular Economy Promotion Law,which plays an important role in guaranteeing the sustainability of China's rapid economic development.However,these laws and regulations are mainly macro-norms,supplemented by micro-norms,and the specific operational provisions are not exhaustive.There are no guiding provisions especially for underdeveloped minority areas in Western China,which makes it difficult for these areas to find detailed legislative basis in the formulation of environmental protection laws and regulations,resulting in deviations in the process of regional legislation.Based on the legislative status quo in ethnic areas and the research of experience of foreign developed countries and domestic developed regions in the legislation of ecological environment protection,this paper illustrated the necessity and urgency of perfecting the legislation of ecological environment protection in these areas.And put forward the basic idea of perfecting environmental protection legislation in ethnic areas from the perspective of changing legislative concept,accelerating legislation pace,strengthening characteristic and democratic legislation,and enhancing effectiveness of legislation with the aim of making contribution to further improvement of environmental protection legislation in minority areas in China.
