Research On The Legislation Of The Separate Regulations On Ecological Civilization In Xinjiang

The writing of ecological civilization into the constitution marks that the construction of ecological civilization has been truly established in the constitution of our country.However,with the gradual development of China's economy and society and the increasing number of population,ecological protection is still an important task of the current socialist modernization.Xinjiang Uygur Autonomous region is located in the northwest border area of China,accounting for one sixth of China's land area.Therefore,it is particularly important to pay attention to the construction of ecological civilization in Xinjiang.Effectively for the ecological environment protection legislation is one of the important means of protection and management,compared with the national laws,regulations and autonomous regulations comprehensive characteristics,special decree has the characteristics of flexible concrete,if separate regulations,formulate more perfect,can better response to the autonomous areas,the differentiated demand for ecological environment protection,also will improve the effect of autonomous areas of ecological protection and economic sustainable development.Based on this,this paper takes the Xinjiang Uygur autonomous region involves the separate regulations of ecological protection as the research object,carries on the text analysis,to separate regulations formulation,all-round analysis about the problems existing in the ecological protection special decree and deficiency,and put forward reasonable Suggestions,in order to can help to promote the perfection of Xinjiang special decree.This article first to the definition of the concept of ecological civilization,this paper introduces the application of it in domestic origin,clear the connotation and nature of the separate regulations and comparing with the autonomous regulations and local regulations,make its characteristics is more clear,and then explains the Xinjiang to develop special decree of ecological civilization construction,the significance of the basic overview of the finished paper ontology.Secondly,from the legislation quantity,time,the improvement of legislation,legislative body,legislation content category reviews the five levels of xinjiangoverall form relating to the ecological protection of separate regulations legislation,mainly from the aspects of the text content of 18 involved in ecological protection special decree has carried on the review,a detailed analysis of the paper sample.Thirdly,the paper analyzes the legislative effect from the aspects of the implementation effect and the degree of judicial application,and finds the legislative value behind,as well as the problems existing in these special regulations.For example,there is a game between a special decree and a local decree,a lag in the legislation,and a high degree of homogeneity in the legislative content.Finally,the author puts forward corresponding countermeasures to solve these problems,and provides data and theoretical reference for the formulation of special regulations on ecological protection in Xinjiang,which not only helps to solve the ecological protection problems in Xinjiang,but also promotes the progress of legislation on Xinjiang autonomy.
