On The Shortcomings Of The Government Information Public Relief System

Government information disclosure is not only related to the right of the public to obtain information,but also with the confidentiality of public information.In order to maintain public awareness and improve the transparency of government work,the Government should take the initiative to disclose to the non-specific people in the administrative process of control,access,preservation of the information,or the applicant's application does not harm the public interest and the interests of others information.Because of the secrecy tradition of government work,this system is conducive to the development of democracy and the rule of law system is facing many difficulties,especially the relief system worthy of attention.In order to solve the above problems,the article mainly through the following four parts:The first part analyzes the government public information relief system.Based on the legislation of our country and the theoretical consensus,the related concepts and connotations of government information disclosure are expounded.The second part summarizes the present situation of the government public information relief system.Respectively,from the government information disclosure system of relief,reporting,administrative reconsideration,administrative litigation four angles to study.The third part introduces the main contents of the legislation of foreign government information disclosure and its relief system.The three representative models of government information disclosure relief system are described in the United States,Britain and Japan respectively.The fourth part is mainly based on the reality of China's government information disclosure system,absorbing foreign advanced experience,and making perfect suggestions on the government's public information relief system.With the promulgation and implementation of the Regulations on the Opening of Government Information,the government information disclosure system has made great progress.But there are still some problems.In the face of the issue of government information disclosure relief,this article creatively put forward the"People's Republic of China Information Disclosure Law",the establishment of information disclosure committee and other recommendations.At the same time,it is of great significance to solve the problem of the government information disclosure in our country.
