Research On The Effectiveness Of The Transfer Contract Of The Right To Contract Management Of Rural Land

The rural land contract management is related to the vital interests of our farmers and the development of the rural economy.The state attaches great importance to this problem.In the nineteen reports,we also made a special discussion on the right to contracted management of rural land,and clearly indicated that China should continue to deepen the reform of the rural system and mechanism in the future,consolidate the basic management system,improve the three right division system of the contracted land,and keep the land contract relationship stable and permanent.In the past,our country was "separating the two powers".With the continuous change of the society,the traditional system could not adapt to the development of the times,and the "three rights division" came into being.The state stands a supportive attitude to the contract and circulation of land.The most common and most radical is the way of transfer.If the treatment is not appropriate,there are many disputes and contradictions,and the effectiveness of the transfer has always been in the division.It is quite controversial in the practice of law.If it is not handled well,it will easily cause mass incidents,which will do great harm to the maintenance of social order,and will also hinder the development of rural economy.The author mainly discusses the effect of contract effectiveness on the transfer of rural land contract management right from four levels.First,the classic case is selected and the contract disputes which are easy to appear in the transfer of rural land contract management right are analyzed.Second,from a legal point of view,the contract for the transfer of rural land contractual management right is expounded.Third,the existing problems and solutions in the transfer of rural land contractual management right.The fourth part puts forward legislative proposals for the right to contracted management of land.This article needs to explain that the land contractual management right in the article refers specifically to the land contractual management right obtained through household contract.
