An Empirical Study On Sentencing Factors Of Unit Bribery Crime

According to By sorting out the criminal judgment of 800 cases of bribery crime originating from the "non litigation net",it takes the area of the case,the nature of the bribe unit,the amount of the bribe unit,the number of the bribe unit,the nature and the light plot as its independent variable,and three kinds of penalty,personal free penalty and personal fine penalty for the unit of bribery.The result of the penalty is the dependent variable,and the SPSS data analysis can be used to find out whether the above 6 factors of sentencing can have an important influence on the sentencing results of the unit bribery cases in judicial practice,namely,the relationship between the unit fine penalty,the severity of individual free punishment and the amount of bribes in the unit,and other variables and units.There is no correlation between the sentencing results of bribery.The overall trend of the sentencing of the unit bribery cases and the influence of the Sentencing Factors on the results of the sentencing of the unit bribery crime are deeply studied.It is found that there are some unreasonable points in the sentencing results of the crime of bribery by the court in judicial practice:first,the unit fine penalty,the state-owned and state owned enterprises are compared.The amount of the unit fined by other units is less,the number of the number of bribes can not affect the result of the penalty sentence of the unit,and the penalty amount of the unit is low and the standard is different.The penalty result of the unit sentenced to the court in the broad plot is contrary to the idea that it insists on the special surrender system.In the aspects of personal freedom punishment,the sentence is slow and the probation rate is high,the number of people who take bribes can not have an important influence on the result of individual punishment and sentencing.The confession of confession is high,and the individual free punishment is easy to be slowed down.The application of errors in the old and new laws is liable to cause the abuse of personal fine penalties.The author hopes to speed up the improvement of the sentencing system of the current unit bribery in China,so as to achieve the effect of judicial justice.
