Research On The Penalty Enforcement Of Official Crime Criminals

Since the eighteen Party’s Congress,the Party Central Committee with Comrade Xi Jinping as the core has been promoting the party’s construction in an all round way,adhering to the strict rule of the party and strengthening the building of a clean and honest government.By strengthening the punishment of the duty crime and the deterrence of the "dared not to rot" on the duty crime,through the revision of the laws and regulations,the system of "can not be rotten"is further perfected,and the consciousness of "do not want corruption" by the state staff is strengthened through ideological education.In the process of investigating the duty crime vigorously,the execution of the criminal offender is a link in the criminal procedure law,and is the last link of the criminal procedure.How to correctly analyze the problems existing in the execution of the criminal penalty in the crime of duty and put forward further suggestions for the future work has become a frontier problem in front of us.Therefore,this paper,starting with the analysis of the concept of the criminal offender,the characteristics of the criminal offender and the principle of the execution of the criminal penalty of the duty offender,analyzes the problems in the execution of the criminal penalty in the duty crime,and puts forward the proposals to improve the execution of the criminal penalty.This article is divided into five parts.The first part is the introduction.This paper analyzes the present situation of the research on the execution of the criminal penalty in the crime of duty,and puts forward the theoretical and practical significance of this study.The research methods adopted include the literature method,the value analysis method and the innovation point of this paper.The second part summarizes the execution of the punishment of the duty crime,sums up the concept and harmfulness of the duty crime,sums up the principle of the execution of the criminal penalty for the duty offender,puts forward the understanding of the concept of the duty crime,and points out the economic construction,the political construction,the cultural construction,the social construction and the construction of the duty crime.The great harm of the construction of the ecological civilization,the concept,the characteristics and the value of the penalty execution of the subject crime in this article are demonstrated,and the various penalties involved in the criminal offenders are summarized,with the emphasis on the immediate execution of the death penalty,the life imprisonment,the reprieve,the life imprisonment,the term of imprisonment,and the imprisonment of the criminal offender of the duty crime.The detention system,several principal penalties and fines,deprivation of political rights,confiscation of property three additional criminal summary.The third part focuses on the analysis of the existing problems in the execution of criminal penalty in the duty crime,mainly involving the problems existing in the execution of the death penalty and the execution of life imprisonment,the problems existing in the implementation of community correction,the problems existing in the execution of sentence reduction,parole,temporary supervision,and the problems existing in the supervision and reform.The fourth part puts forward solutions for the problems existing in the execution of duty offenders.The fifth part is the conclusion.
