With the rapid economic development of our country,which arouses more and more economic dispute cases;a lot of cases with no property for execution have been produced in judicial practice and at the same time,a lot of cases with no property for execution can't exit the execution procedure of the court and cause the problem of discontinuation of execution.Terminating this execution procedures made by each local court under this background through groping and creating continuously.Terminating this execution procedure plays an important role in dealing with the cases with no property for execution;at the same time,some problems have been exposed in the application process.Under the above background,this paper has proposed targeted and reasonable suggestions for improving and terminating this execution system through investigation,combining the practical operation situation of terminating this execution process and on the basis of discovering problems.In the following,the preparation of laws and regulations confirms this terminating execution procedure as a basic settlement form for legal cases of execution.The contents of procedure have been improved.This paper writes by taking “Investigation Report of Terminating this Execution System-by taking S Court as research object” as the topic.The article consists of three parts.The first part takes S Court as the investigation sample and introduces the basic situation of enforcement of civil cases in S Court as well as the applicable situation of terminating this execution procedure.The second part discusses the disputes existed in the applicable process of this procedure as well as the reasons behind through analyzing the applicable situation of S Court in terminating this execution procedure as well as the searched applicable status of other courts.The third part makes reflections on improving our termination of this execution system,which include the elaborations for the necessity of improving the termination of this execution system as well as the proposed targeted improvement suggestions through analyzing and summarizing the above researches.The improvement for the termination of this execution system is of important significance for optimizing the allocation of judicial resources,improving the execution efficiency of the court,safeguarding judicial authority and assisting in solving the problem of difficult execution etc.
