Research On Criminal Laws And Regulations For Internet Financial Equity Crowdfunding

Internet Financial Equity Crowdfunding is a new type of financial model.Due to the special nature of the Internet,this behavior pattern does not have a uniform standard.The final result is that the Internet Financial Equity Crowdfunding Behavior is exposed to a great criminal risk.For a long time,the development of small and micro enterprises has been constrained by financing difficulties.Therefore,the IInternet Financial Equity Crowdfunding has emerged in this situation.Since this innovative financial behavior model can promote the development of small and micro enterprises,the future research hotspot is the reform and redevelopment of this novel behavior.However,it is no easy work for healthy and steady development of Internet Financial Equity Crowdfunding.On the one hand,the development of this behavior requires new financial models,data and technologies;On the other hand,more powerful regulatory systems are needed,especially the regulation of criminal law.Based on the above research environment,the contents of this paper are as follows: Firstly,the concept of Crowdfunding and Internet Financial Equity Crowdfunding is introduced.Secondly,it shows the current development of this pattern of behavior in our country and the necessity of research.Then,to introduce the “Access Restrictions” and “Alienation Possibilities” that exist in this behavior model,these two special words were proposed by Professor Liu Xianquan of East China University of Political Science and Law.Finally,combine with the outside of the legislative experience for the act,analyze the behavior of the criminal law and regulation.The regulation of the criminal law must be used as it is.For the criminal acts that have been implemented or are in the process of being exploited should be strictly punished and not lenient.However,criminal law can not be over-used.Excessive regulation will limit the development of this new-born Internet Financial Equity Crowdfunding.Therefore,relevant laws should explain the special circumstances and avoid misjudgment so as to ensure the healthy and sustainable development of this mode of behavior.
