Research On The Judicial Governance Of Educational Equity In The United States

Judicial governance plays an important role in the national governance system of the United States.The judicial governance of the United States can be seen both in major moral dilemmas and in the disputes over the presidential election.The administration of justice in the United States is no exception to that of fair education in the United States.Since 1954,when the Federal Supreme Court passed a decision in Brown's case,which gave effect to the abolition of the apartheid policy of "separate but equality" in school education,judicial governance has has played a significant role in the governance of the two main fields of educational equity and education finance.Due to the significant role that educational equity played in the society development and equity promotion is becoming more and more obvious,it is gradually becoming an important area of government governance.Because of the limitations of the United States political system,the legislation and administration face many obstacles caused by the American democratic defect or the conflict between the federal and the state in the power and administration of education.In the endless disputes of educational fairness,Judicial governance is based on the constitution and the law.Through a series of judicial techniques,a certain effect of promoting educational fairness has been formed in the judgment of disputes,by adjusting and repairing these defects and obstacles.This paper takes the judicial governance of American educational fairness as the case to form the empirical enlightenment to the construction of our country's rule of law society and to rule the country according to the constitution on by analyzing the the foundation,reasons and methods of judicial governance,which is divided into four parts.The first part is the basis of American educational fair judicial governance.It mainly analyzes basic advantages of the judicial governance participates in the national governance,intervenes in the governance of education equity affairs and other aspects to form track from its power basis,the legal basis,the judicialphilosophy foundation and the practice foundation.The second part is the origin of American educational fairness judicial governance which analysis of the reasons for judicial intervention in education fairness mainly from three clues: political system,laws and regulations,and political process.The third part is the judicial governance of American educational fairness which is based on the analysis of the major political systems and legal contradictions in the process of educational fairness.It summarizes and deduces regulating the educational rights of the federal and state governments,the usual litigation channels for the administration of justice and the standards and applicable conditions of unconstitutional review of laws and regulation of judicial governance.The 4th part is the enlightenment of the judicial governance of American educational fairness.On the basis of summarizing the judicial governance of American educational fairness,the author deeply explores the beneficial implications of the judicial governance of American educational fairness for our country.
