| With the rapid development of social economy and the increase of residents' income,the number of motor vehicles in China is increasing year by year.According to the data of the Ministry of Public Security Management Bureau,by the end of 2016,there were 290 million vehicles and 360 million motorized motorists in China.Motor vehicle facilitates people's production and life.Due to irregular driving and other serious violations of road traffic safety laws and regulations,it brings some problems that are not conducive to social stability and people's living and working.The law regulation and punishment of property major traffic accident crime as China's criminal law regulations for illegal transportation caused by the behavior,has become a number of grass-roots procuratorate for examination in China at the present stage of the arrest,the basic court trial of criminal cases in many a class.J county is a mountainous county in inland areas,with the development of social economy,the amount of car ownership per capital and drivers increased year by year,at the same time,the number of traffic accident crime also hold the trend of rising year by year,J County traffic accident crime situation has also appeared in many similar areas throughout the country.Therefore,the characteristics and problems arising from the traffic accident crime in J County,to a certain extent,represent the characteristics and problems of traffic accident crime cases in some parts of the country.This article through to the J County in 2014 2016 traffic accident crime and meticulous investigation and careful analysis of research,summed up the main characteristics of the traffic accident crime,and analyzes the reasons based on the specific circumstances and issues in order to accurately grasp the traffic accident crime,find out the problems with the method.And hope to be able to have the similar area reference and help to other nationwide.This research report is divided into three parts:The first part is the origin and significance of the topic.The main content of this part is to elaborate on the rapid increase in the number of traffic accident crimes in the context of the rapid development of the national economy.J County,as a traffic accident crime prone area,it is of practical significance to study the crime of traffic accident.The second part is the basic situation.This section is a brief and brief description of the whole research situation from three aspects:the research site,the investigation process and the research method.The third part of the survey analysis.This section describes the basic situation of traffic accident crime in J County,the problems and causes in J County traffic accident crime treatment and the three parts of the problem.The basic characteristics of the traffic accident crime in J county have six points:first,the number of crimes continues to rise,the annual growth continues to increase;second,the cases occur in a specific time and region;third,the sex of the perpetrators is male,the age of the accident also develops to the low age;fourth,the number of toxic driving is on the rise;fifth,the situation involved in the rapid rise of the vehicle caused by the accident;and sixth,the "escaping"behavior continued to grow too fast.There are seven problems and the corresponding reasons in the handling of the crime of traffic accident in J county.First,the trend of simplification of the application of the procedure is aggravated;second,the mediation tendency of the criminal reconciliation is intensified;third,the application of the criminal punishment is less,the community correction is widely applied;fourth,the identification of the subject of the crime;and fifth,about "escape" Cognizance;sixth,the application of voluntary surrender in traffic accident crime;and seventh,the identification of "replacement" after traffic accident.There are also seven suggestions for the corresponding problems.Among them,the first two aspects involve procedural problems in case handling,and the other five involve substantive problems in case handling.Through a specific analysis of problems,summarizing reasons,finding countermeasures and making suggestions,we put forward an operable suggestion for the problems arising from traffic accident crime handling,and put forward some thoughts for some problems which are still hard to solve. |
