Research On The Prevention Of Administrative Law Enforcement Risks From The Perspective Of Administrative Self-control

With the words "service-oriented government","government power list","law enforcement process records" and "administrative law enforcement responsibility system" and other words gradually become familiar to ordinary people,we experienced the executive staff is Gradually change the arrogant attitude of the past,with the image of a real public servant to serve the administrative counterparts,the same change also occurred within the administrative organ.All along,the legislative and judicial organs are sparing no effort to solve the issue of the exercise of administrative power.However,the effect is limited.This is not because the legislature or the judiciary have not fully exercised their power but because legislation and the judiciary can not regulate the exercise of administrative power from the source.The emergence of the theory of administrative selfcontrol provides a possibility for preventing the risk of administrative law enforcement,that is,preventing the risk of administrative law enforcement from within the administrative organ.Therefore,based on the long-term concern about the theory of administrative selfcontrol and the risk of administrative law enforcement,this article will study how to prevent the risk of administrative law enforcement from the perspective of administrative self-regulation under the guidance of administrative self-regulation theory.First,this article will take the administrative law enforcement risk and the theory of administrative selfregulation as the starting point to study the concept and basic characteristics of the risk of administrative law enforcement.Second,analyze the objective conditions of administrative law enforcement in our country to determine the main risks in the administrative law enforcement activities in our country.Thirdly,Analyzes the causes of the risk of administrative law enforcement and deepens the understanding of the risk of administrative law enforcement.Finally,it analyzes the feasibility and advantage of the theory of administrative self-defense against administrative law enforcement and establishes the superior position of preventing the risk of administrative law enforcement from the angle of administrative self-According to the actual situation in our country,the specific measures to prevent the risk of administrative law enforcement from the perspective of administrative self-regulation are determined,including the precautionary measures against the risks of administrative law enforcement,the control over the risks of administrative law enforcement and the post-accident response to the risks of administrative law enforcement.
