Over the years,China's economic downward pressure is larger,the real estate industry inevitbly encountered cold winter.the real estate industry has been on a downward slope,continuing to be depressed,and the property market is also in a depressed state.In addition,due to the impact of the economic situation,the capital chain is broken,and the capital is difficult to withdraw,which makes it difficult for the real estate industry to operate.With the tightening of the government's macro-control policy,the serious saturation of the market,the bankruptcy case of real estate company continues to heat up,a large number of real estate companies bankruptcy cases frequently appear.The cases of creditors applying for bankruptcy of real estate companies are on the rise.In the practice of bankruptcy of real estate companies,many new and old problems coexist and new and old contradictions are intertwined,which is also not conducive to the stable development of society.It will also affect the healthy development of the commercial housing market.Therefore,the issue of right ranking in the bankruptcy liquidation procedure of real estate companies in China has caused quite a lot of controversy.And the real estate company after bankruptcy involved a wide variety of stakeholders,diversity of creditor 's rights.when the real estate company enters bankruptcy proceedings,there will inevitably be conflicts between the fineness of the bankrupt property and the diversity of claims.the limited bankruptcy property is not sufficient to settle all claims.at this time,the status and nature of each claim directly relates to whether the interests of each creditor can be fully or partially satisfied.in order to better deal with the interests of the main interests between the relationship.In this paper,the basic theory of right ranking in bankruptcy liquidation procedure is studied,and the theoretical basis of right ranking in bankruptcy liquidation procedure is discussed.Then to point out the main problems existing in the procedure of bankruptcy liquidation of real estate companies in China,including: the priority of the demolition creditor's rights,the protection of the creditor's rights and interests of consumer buyers,and the granting of priority to them;The construction project price creditor's right priority;then to the above question one by one thorough analysis,finally proposed the consummation opinion.
