Owing to the “medical trouble”,the legitimate rights and interests of the medical organizations and medical personnel are infringed,more than that,the “medical trouble”is likely to disrupt the medical treatment order and will also harm the whole society.Because of these,the “medical trouble” become a hot issue in recent years.In addition,the relations between doctors and patients has becoming very nervous in country,and the type and reasons cause the diversification of the “medical trouble”.Though the “medical trouble” has been treated as a hot issue,yet there still lacks theoretical study.From the current research,one of the most important reasons is the nervous relationships between the doctors and patients.Furthermore,when the rights of the medical organizations and medical personnel are infringed,there are no relief measures.This text will focus on the concept and reasons of the “medical trouble”,besides,I will further study the legal constitution ? the legal status and the legal value of the “medical trouble”,so that these research results can provide guarantees for the legal system which will be build.What's more,This text will study the problems of the current judicial practice by the several cases as well as to research the foreign and the ancient measures,hoping to build a legal system which can provide both prevention and relief afterwards for the doctors?patients and the medical organizations.
