On The Internal Supervision And Improvement Of The Police Power In Our Country

Public security organs have constantly strengthened the standardization construction of the law enforcement in recent years.However,incidents of civil right infringement caused by non-standard use or even misuse of the police authority have happened occasionally.Where is the boundary of the police authority? Who is the supervisor? How do we undertake the supervision? How can it be effective? All those have become the burning questions.As a staff in the complaint department of the public security organ,in practice the author has found that there are various problems in the internal supervision of police authority,such as the unclearness of the supervisory subject’s power and responsibility,repetition of supervision,lack of coordination,buck-passing,ineffectiveness of initiative supervision and pre-supervision,which badly influence the comprehensiveness,timeliness and effectiveness of the supervision.It is necessary to further the exploration of improving the internal supervision of police authority.Viewing from the perspective of holistic governance,the paper attempted to investigate and probe into the status and problems with internal supervision of police authority in China.It began by clearly defining relevant concepts on the internal supervision of police authority and holistic governance theories,combing relevant theories and research overviews and elaborating the logical consistency between holistic governance theories and improvement in internal supervision of police authority.Next,it summed up the basic institutional structure and practical operation of internal supervision of police power in China.Analysis was made of existing problems with internal supervision from the perspectives of organizational and institutional structures.It was found segmented internal supervision was typical of Chinese public security organs and underlying causes were ascertained.It concluded with suggestions for improving internal supervision of police authority,based on holistic governance theories,from the perspectives of value orientation,governance strategies,governance mechanisms and methods.Besides,based on personal experience in establishing the functional modules for law enforcement(petition system)risk assessment and early warning system,the paper proposed to establish police power supervision platform and facilitate resource sharing,functional integration and procedure connection through information technologies.This way,it will help to integrate supervision functions,power and institutions,achieving the holistic governance goals in internal supervision.
