Assisting the investigation is not a legal term with strict definition in the law.Its meaning is rather vague.From the perspective of the “Criminal Procedure Law” alone,it is difficult for us to accurately grasp its nature and function.The research that assists the investigation involves a series of questions such as preliminary investigation,case filing,compulsory measures,evidence system,and even other departmental laws.It is a “seemingly simple but actually more complex”issue,but there are currently fewer targeted research results.It deserves extensive attention and in-depth discussion.In terms of institutional outlook and program construction,this article only makes a brief analysis to allow for further exploration and research.This article is divided into four parts:The first part makes a basic understanding of the causes of the alienation of assisting investigations in the legislation and the judiciary.In the second part,a deep analysis was conducted on the preliminary investigation system and the case filing system that assisted in the investigation of "basic soil" and "form attribution." In the third part,a number of derivative issues that assist in investigations are reasonably discussed.Concluding remarks,preliminary suggestions are made on the establishment of systems for assisting investigations.
