Research On Intellectual Property Protection Of Clothing Design In My Country

With the deepening of the "innovative" development of the country,the garment industry based on innovation is also in the key stage of the transformation and upgrading.The traditional fashion industry has limited consciousness of independent innovation and limited innovation ability,which has hindered the development of local clothing brand to a certain extent.Have the world in view,there are many well-known clothing brands in Europe and America and other developed countries.In the protection of clothing design,we can learn from them,but we should still consider the right path based on our national conditions.This paper is divided into four parts: the first part describes the "clothing design" and other related concepts,in order to clarify the boundaries of "clothing" and "clothing design",in order to highlighting the protection of industrial design patent;the second part analyzes the limitations of "copyright law" and "trademark law" on the protection of clothing design,so as to demonstrate the legitimacy and feasibility of the design patent protection.;the third part mainly discusses the protection of design patent,according to the European Union "design instruction" that distinguish the registered design and the non-registered designs,the industrial design patent protects the registered design,and the anti unfair competition law protects the non-registered design;the final part is based on the problem mentioned in the third part,and put forward my own legislative suggestions.
