This paper focuses on the boundaries between excessive rights protection and extortion.The article is divided into four parts.In the first part,three typical cases are passed,which leads to the analysis of legal issues.On this basis,the second part discusses the meaning and characteristics of excessive rights protection,analyzes the connotation of excessive rights protection,the private relief of excessive rights protection and the infringement of legal interests,deeply interprets the characteristics of excessive rights protection,and sorts out the content of rights protection.The threat of sexuality,the means of safeguarding rights,and the excessiveity of claims for rights.The third part analyzes the difference between the excessive rights protection and the extortion and extortion in the three aspects of legal infringement,subjective aspect and objective behavior.It can be found that the excessive legal rights and the extortion are less invasive than the extortion.The actual urgency caused is relatively small,and the actual damage caused is also slightly smaller.Subjective activists are not necessarily subjective to illegal possession.They may have certain cognitive errors and subjective malignancy.Therefore,the means of excessively defending rights and obtaining property has certain legitimacy,and its means are relatively simple and peaceful.Will be violent coercion.Finally,the article makes recommendations on the specific definition of excessive rights protection and extortion.It believes that the amount of claims should not be used as the boundary between crime and non-crime.Threatening rights should be differentiated.Excessive rights protection using violent means should be punishable.Excessive rights protection for legal guidance.
