Research On The Rules For Determining The Illegality Of Resale Price Maintenance

The current anti-monopoly law of our country has vague provisions on resale price maintenance.It only involves the provisions of articles 14 and 15 of the anti-monopoly law,leading to different understandings of articles 14 and 15 in various sectors of society.In practice,the judicial organs and the law enforcement organs have adopted different judgment standards on the illegal determination of cases of the same nature,and there are great differences.The difficulty of the illegal determination rules of resale price maintenance not only affects the authority,certainty and predictability of the law,but also has a negative impact on the law enforcement activities of the anti-monopoly enforcement authorities and judicial activities of the judicial organs.Therefore,in the current context,it is necessary to study the illegal determination rules of resale price maintenance,and to unify the criteria.This paper first introduces the basic theory to make a comprehensive understanding of resale price maintenance behavior,and then analyzes,compares and discusses the regulatory rules of developed economies such as the United States and the European Union.Based on the National conditions of our country,this paper puts forward some regulatory suggestions for optimizing resale price maintenance.
