The right of judge interpretation is an indispensable part of civil litigation law in civil law system,and the right of judge interpretation is of great significance to the realization of the purpose of civil action.A more profound understanding of the judge's interpretation power is helpful to the gradual advancement of the judicial reform in our country.At present,in the judicial practice of our country,more and more attention is paid to the judge's interpretation power,and the related provisions increase year by year.However,these provisions are scattered in part of the judicial interpretation,and have not formed a systematic and complete framework,which is not conducive to the judge's interpretation power playing a role in the practice.The fundamental reason is that the proposal and development of the judge's interpretation right in our country is a reference to the interpretation right system of the civil law system,the theoretical foundation is weak,compared with them,the development time of the interpretation right in our country is short,and it is not enough to run in with the judicial practice of our country.And lack of matching system.Therefore,it is necessary to further study and improve the interpretation power of judges in our country,promote judicial justice,improve the efficiency of litigation,and protect the rights and interests of litigants in litigation and entity.This paper first discusses the connotation and function of the judge's interpretation right,then summarizes the legislation and judicial situation of the judge's interpretation right in our country,and finally analyzes the necessity and path of perfecting the judge's interpretation right system in our country.
