Criminal Law Protection Of Citizens' Personal Information

In this paper,through a large amount of case selection,cited in "about to handle criminal cases of infringement of citizens' personal information to explain some issues of applicable law after the formal implementation of two classic criminal cases infringing upon the citizen information,through the comparative analysis,from the focus of dispute case for the entrance,combined with the trial process control contend on three sides,the focus of the controversial put forward reasonable solution.The author first summarized the phenomenon of abused to citizens' personal information,further stated in the fast-changing era of big data,citizens' personal information of the criminal law to protect the status quo,combined with the "criminal law amendment" nine and the latest judicial interpretation on the handle criminal cases of infringement of citizens' personal information to explain some issues of applicable law,in view of the complicated disputes in judicial practice focus for further instructions.Guided by the identification of criminal means and behavior patterns,this paper breaks down the basic concepts of information about citizens and personal information and integrates the latest viewpoints of different scholars.In the aspect of the judicial identification of the crime of violating citizens' personal information,this paper takes the judicial practice as the background,analyzes the two problems of "violating the state regulations" and "serious cases" in depth,and puts forward my own views.Finally,from the perspective of macro legislation,the author points out that at this stage,China's laws on the protection of citizens' personal information are scattered,and the provisions of criminal means and methods are narrow.On this basis,combined with the provisions of the latest criminal legislation in China,this paper puts forward legislative Suggestions on improving the fine penalty and increasing the employment prohibition,so as to improve the criminal law protection of citizens' personal information.
