A Study On The Effect Of Unilateral Disposal Of Husband And Wife's Joint Property

Family is the cell of society.Good and harmonious family relationship is the cornerstone of social stability and development.Husband and wife play an important role in family relations.Husband and wife relations involve identity relations and property relations,among which property relations directly affect the harmony and stability of husband and wife relations.With the continuous development of the national economy,the number of property owned by families is increasing,and the number of property disposable by couples is also increasing day by day.At the same time,the unauthorized disposition of common property by one spouse is also emerging in an endless stream,causing huge property losses to the other spouse,even to the whole family.Therefore,in the field of marriage and family,a more complete property system is needed to restrain the unilateral disposition of the common property of husband and wife and to relieve the victims in the transaction.This article is divided into three chapters to discuss the effectiveness of unilateral disposal of the joint property of husband and wife.Firstly,the first chapter introduces the basic theory,introduces the basic content of common property and unilateral punishment;secondly,the second chapter analyses the effectiveness of unilateral punishment,and seeks the remedies for the injured party;finally,the third chapter puts forward legislative proposals to provide a plan for improving the legal system of marriage in our country.
