Research On The Legal Rules Of Electronic Bills

In recent decades,the rapid development of network technology and electronic information technology has brought unprecedented changes to financial markets.As a new type of " negotiable instrument ",electronic negotiable instrument emerges as the times require.If the emergence of negotiable instruments is a revolutionary breakthrough in the mode of cash transactions,the application of electronic negotiable instruments will be another revolution based on traditional negotiable instruments.Because of its electronic and network characteristics,it will bring great challenges to the Negotiable instrument Law,mainly manifested in the absence of core legislation on electronic negotiable instruments,the imperfection of supporting legal system and the characteristics of electronic negotiable instruments.Special legal norms can not be effectively integrated into the system of the Negotiable instrument Law.Electronic negotiable instrument has been applied in practice in China.If it can not be regulated by legislation in time,its development will be hindered,and it will not be conducive to the transaction security of financial markets.This paper discusses the concept and characteristics,development and system construction of electronic negotiable instrument,and puts forward relevant suggestions for the legal system construction of electronic negotiable instrument in China.
