Research On The Causality In The Civil Liability Of Securities Misrepresentation

The nature of the security market is capital market,and it's an important part of China's market.Since the reform and opening up,with the sustained and rapid development of China's market economy,the securities market is also constantly making vigorous progress,which is a sign that China's market economy is becoming increasingly perfect and mature.However,the occurrence of some major and important cases in the securities market shows that the legal system of China's securities market is not perfect enough,which has caused great losses to the majority of securities investors,especially small and medium-sized investors.False statements,insider trading,manipulation of the market,cheating customers and other behaviors all happen all the time.Among them,as a typical violation of securities laws and regulations,false statements have triggered a series of major cases in China's securities market.They not only caused great property losses to securities investors,but also severely damaged their confidence in participating in investment,and caused serious damage to the development of China's securities market.In the trial of a false statement case,the most difficult to identify and discriminate is the causal relationship in the civil liability caused by the false statement behavior.It can be said that the determination of the causal relationship in civil liability is the difficulty and key in the whole false statement case.However,at present,there are still many deficiencies in the law of our country.Therefore,the purpose of this paper is to analyze and explore this issue,and put forward some opinions on the basis of combing and summarizing,in order to provide assistance for the development of securities law and the improvement of securities market in China.
