Research On The Grace Period System In The United Nations Convention On Contracts For The International Sale Of Goods

The United Nations Convention on Contracts for the International Sale of Goods has had a wide and far-reaching impact on the international trade.The trade rules and the system of default remedy have been widely studied by many scholars,and the period of grace system which contains Articles 47,49,63 and 64 of CISG has drawn lots of attention and special research.This thesis will analyze the period of grace system and conduct independent research on it,which would expound the unique value and significance of the systemThe first part of the thesis closely follows the topic of the theme,and defines the basic concepts involved in this paper.The highlight is on the legal basis analysis of the grace period.The second part focuses on the legislative process and terms of the grace period clause in the United Nations Convention on Contracts for the International Sale of Goods.The third part mainly focuses on the cases involving the grace period in the international trade disputes,mainly focusing on the notification procedure of the grace period and the identification of the grace period.The fourth part is related to the major developed countries in the world.The legislative practice of grace period and timeliness of contract implementation.The fifth and sixth parts discuss the reference significance of CISG grace period system to China's contract law,and emphasizes the issues of "urging" and"terminate the contract after reminders".The highlight of this thesis is that I have mastered the minutes of the delegations' meetings on the terms of the grace period in the Vienna Diplomatic Conference.The details of the topics discussed in the meeting and the views of the delegations can help us to acknowledge the provisions through the perspective of the legislator.
