On The System Of Civil Retrial Review And Hearing

The civil retrial system is one of chinese civil lawsuit system that is especially special and important.The problems in its system construction require us to conduct in-depth and meticulous exploration.In this article,I will conduct a detailed study of the review hearing system in China’s civil retrial.Firstly,this paper starts with the investigation and analysis of the civil retrial review hearing system of the provincial court,and adopts the combination of literature research and case study to elicit legal thinking on the civil retrial hearing hearing in China,and then review the civil retrial.The concept,characteristics and significance of the hearing system are systematically elaborated.On the basis of this,this paper analyzes the status quo and dilemma of China’s civil retrial review hearing system,and believes that the legislation of China’s civil retrial review hearing is not perfect.China’s civil retrial review hearing system is in a difficult position.These dilemmas are concentrated in the review channel.Hearing procedures and hearing documents and many other aspects.Therefore,this paper proposes to standardize the civil retrial review hearing system from the legal level,clarify the principle of the civil retrial review hearing system and improve the civil retrial review hearing supporting system and other specific suggestions to improve the civil retrial review hearing system in China.This paper sorts out the dilemma of the operation of the civil retrial review hearing system,and puts forward the legal perfection suggestions for the system operation dilemma.It has profound reference significance for the legislative perfection and judicial practice of the civil retrial review hearing system.
