Research On Compulsory Medical Procedures

With the increase of the incidence of mental illness in China,the number of serious cases of violence committed by mental patients is increasing every year,which brings endless harm to the families of victims and even the whole society.At present,more than 16 million patients with severe mental illness in China,mental illness has become a serious public health and social problems.Compulsory medical procedures from scratch,to fill a big gap in China's law,to solve the "martial madman" problem has a law to follow,is very commendable.However,due to the large population in China,the scale of the applicable population is relatively large,and the compulsory medical procedures in China are not mature due to the relatively short implementation time,there are some problems to be filled in all aspects.By sorting out the typical cases of compulsory medical treatment in practice,this paper analyzes some common problems such as the narrow scope of the object of such cases,the lack of definitions of relevant concepts,the defects of initiation procedure,the defects of execution procedure and the defects of supervision and relief procedure.Combining with the study of the concept,purpose,nature,object and application of the criminal compulsory medical procedure,this paper discusses the imperfection of the criminal compulsory medical procedure in our country,and puts forward some questions about the application conditions,object,starting subject,trial,execution procedure,operational procedure,connecting procedure and supervision and relief of the compulsory medical procedure.Some suggestions for improvement.
