Investigation And Analysis Of The Crime Of Divulging Citizens' Private Information By Public Security Police

In recent years,public security police as the main body of violations of personal privacy information crime is more frequent hair,it has greatly affected the functions of public security organs and the credibility of public security organs.The contradiction between the performance of public security organs and the protection of citizens' right to privacy began to appear in our society,and caused great concern of public opinion.For the public security organs,it not only undertakes the social administration work,at the same time,has assumed the social order maintenance work.Therefore,compared with the general administrative law enforcement agencies,public security organs and public security police and other subjects,once become the source of criminal activities,social harm is often greater.This is especially true for citizens who commit crimes of privacy information.In this context,there is no doubt that it is necessary for the public security police to disclose citizens privacy information crime to investigate and analyze,then realize the effective regulation of this kind of crime.In view of this,this paper systematically analyzes the causes of the crime of violating citizens' privacy information from four aspects: legal reasons?social reasons?mechanism reasons? prevention and control reasons,based on the analysis of the causes of crime,the prevention and control strategies of special prevention are putforward.From the aspect of the perfection of criminal legislation,we will further revise and perfect the criminal legislation of the crime of abuse of power and the crime of neglect of duty.At the same time,we should cultivate public privacy protection consciousness including public security police and construct investigation protection and general prevention and control mechanism based on the protection of citizens privacy information.The research of this paper is divided into five parts.In the first part,the purpose and significance of this research are briefly introduced,and the research achievements of domestic and foreign scholars in this field are summarized.The research methods and contents of this paper are briefly introduced.In the second part,mainly summarizes and analyzes the typical cases of public security police in the course of judicial practice revealing the personal privacy information of citizens.The corresponding case selected,the course of the crime and the results of the treatment are discussed.In the third part,through the interpretation and analysis of the relevant cases in the preceding article,puts forward the three problems that this paper mainly aims at.That is,why the public security police to take on the role of combating crime in the face of personal privacy of citizens,has become the main crime.Why such as public security police,abuse of power to traffic in personal privacy information of citizens is prohibited.How should the boundary between the disclosure of police information and the protection of private information of citizens be constructed.And then on that basis,the characteristics and types of the crime of public security police revealing private information of citizens are analyzed.In the fourth part,mainly aims at the public security police to violate the citizen privacy information crime the reason has carried on the research and the analysis,on the basis of the research and analysis,the author puts forward that the criminal law of public security police can not regulate the crime of revealing citizens' privacy information?the national privacy protection consciousness is not strong? the citizen privacy information protection mechanism is missing ? lack of control mechanism for citizens' privacy disclosure four main problems.In the fifth part,aims at the four problems mentioned above,and puts forward the corresponding solutions.That is,we should improve the criminal law regulation of public security police to divulge citizens' privacy information ?strengthen the cultivation of the concept and consciousness of privacy protection between citizens and police ? the construction of the mechanism of protecting citizens' privacy information? the construction of the protection mechanism for the prevention and control of citizens' privacy information,etc.
