Research On Several Issues Of Mediation-type Bribery Crime

The issue of corruption has always been a key issue that has been committed to punishment and combat in various countries and regions around the world.Bribery crime is one of the most difficult problems in corruption.Such crimes are harmful to the development of the whole society,the inner cohesiveness of the people and the national interests represented by their duties.In recent years,bribery violations have become increasingly rampant.Even though the country has introduced many policies and regulations,the judiciary has caused the hiddenness and diversity of criminal means in a series of duty crimes,such as the lag of the law itself and bribery crimes.There are many obstacles in handling such cases,and there are many negative effects on many aspects such as the stability of the country and society and the expectation of the national heart to the law.This article is a study of some issues in the crime of bribery.This crime was written into the criminal law in 1997.The term "mediating bribery" is a summary of the 388 article of the criminal law in China.It is a unique one in the crime of accepting bribes.The behavioral model is also a new type of bribery model that has emerged in recent years.It plays an indispensable role in the legal system of bribery crimes as stipulated in the criminal law.Since the acquiescence of bribery is later than other bribery crimes,there are many problems in theory that need to be resolved.Starting from the concept of the circumstance of accepting bribes,this paper introduces the legislative status of the countries in various countries and regions for the crime of mediating bribery,and expounds the two constitutive elements of subjective and subjective aspects of the crime,and will constitute the elements.The key disputes are combined with actual cases to conduct a separate analysis and viewpoint display.The crime is compared with other types of bribery crimes in China's criminal law,and finally the suggestions for perfecting the criminal law are elaborated.From the theoretical and practical aspects,it demonstrates the true meaning and shortcomings of the criminality of bribery,and hopes to help the legislation of the criminality of bribery and the improvement of the legal system of bribery crime.Mediate bribery...
