Research On Several Issues Of False Litigation Crime

With the development of our economy and the speeding up of the rule of law,civil action become more choice to choose a check for the way of dispute,the false litigation also arise,in this paper,based on the analysis on the subject,the object of this crime,analyses the affected by the civil law and in the crime of false action brought by a third person without or with limited capacity for conduct and legal agent and determination and the main body of this crime object attributes,and based on object attribute is the research object of obstructing justice in order behavioral offence committed or results,and fabricating facts in the cognizance of the fact that conceal the truth and fabricated parts.In addition,this paper also focuses on the differences in the judicial application of the crime of false litigation,including the impact of civil law on the crime,the difference between determining that the accomplice of the crime should be more important than the accomplice of the result,and the basis of the fraud in the fraud of false litigation.
