Research On The Adult Guardianship System

With the renewal of the international concept of human rights and the advent of an aging society,countries around the world are facing an important issue,that is,how to guarantee the lives of adults who are incapacitated by oldness and disease.The adult voluntary guardianship system solves this thorny problem well,finds an outlet for the vulnerable groups,and provides a new idea for the country to place the elderly.The introduction of the general provisions of Civil Law of the People's Republic of China marks the establishment of China's adult voluntary guardianship system.However,compared with foreign legislation,Chinese legal provisions are still too principled,the absence of the relevant provisions of the guardianship contract,the lack of safeguard procedures,the lack of guardianship supervision mechanism,so that the adult voluntary guardianship system lacks maneuverability.In response to these problems,it can be improved in the future when mulling rules or judicial explanations,including: perfecting the provisions of the guardianship contract,clarifying the rights and obligations of both parties,establishing the safeguard procedure of notarization and registration,and establishing the guardianship supervision system.
