Research On The Legal Issues Of The Disposal Of Frozen Embryos

The development of embryo freezing technology has brought hope to infertile couples.Embryo freezing can not only effectively improve the success rate of assisted reproductive surgery,but also help to maintain the health of the recipient women.Although freezing embryos can effectively solve the fertility problem of infertile patients,the emergence of frozen embryos also produces some new disposal disputes.There is no special law in China on how to solve the disputes of frozen embryos.In order to solve the disputes on the disposal of frozen embryos,the legal attribute of frozen embryos should be defined firstly,then the right subjects and disposal methods of frozen embryos should be determined,and finally the disposal rules should be analyzed.This paper discusses three theories about the legal properties of frozen embryos and holds that frozen embryos should be regarded as ethical objects.The husband and wife are the legal parents of the frozen embryo and have limited ownership of the frozen embryo.In view of the different situations of frozen embryo disputes,the respective applicable disposal rules are explored.Combined with China's national conditions,this paper puts forward some Suggestions on the basic principles of frozen embryo disposal,the establishment of embryo donation system,and the improvement of China's legislation,etc.,in order to help solve the dispute of frozen embryo disposal.
