Network click contract is a breakthrough of the existing traditional contract.It is a contracting form embodied by the network form terms,which combines the network agreement with the form terms so as to show it in a form of contract by clicking the contract form.With the rapid development of modern society,reversed transmission transformation in all walks of life,the Internet has also is an essential part of people's life,the past also gradually abandoned traditional trade way,is more of a virtual delivery,thus the click on the appearance and development of the contract is inevitable,click on the birth of the contract,though great brought convenience for people on both sides of the contract,for this kind of contract,how to achieve unity on fairness and efficiency,how to better promote the stable development of the Internet and click on the improvement of the contract,the legal issues of study click on the contract and the presence of defects is particularly important.Therefore,this paper use case analysis and comparative research to relevant judicial case study to find out the deficiency existing in the wrong,and compared both at home and abroad about clicking contract legislation and the judicial attitude to find related perfect measures,especially in view of the legislation and enforcement mechanisms for puts forward some proposals concerning the improvement of trade imbalances and implementation method,hope I can a little contribution to regulation,click on the contract.This paper USES the combination of case analysis and comparative analysis to find out problems through cases,and then draws inspiration through comparing domestic and foreign legislation and research status quo,and finally comes to the improvement path of network click contract through analysis.In addition to the introduction of chapter one and the conclusion of chapter five,this paper is divided into three parts.The first part discusses the necessity of research on network click contract.The second part discusses the limitations of judicial relief in click contracts through the analysis of the current situation of legal regulation of click contracts in China and relevant click contracts.The third part,by studying the American law and the European law,finds the enlightenment to our country on the network click contract,and then conducts the regulation and supervision on the network click contract from the legislative level and the implementation level.In this way,such contracts not only bring convenience to transactions,but also bring justice and fairness to the public,so as to promote the long-term healthy and stable development of Internet transactions.
