Research On The Legal Issues Of The Standardization Of Farmers' Professional Cooperatives

In recent years,with China's attention to the issues of agriculture,rural areas and farmers and the strong support for agriculture,China's Farmers' Professional cooperatives have also been unprecedented development.The number of Farmers' Professional cooperatives is also increasing year by year.In recent years,the number of farmers' professional cooperatives is growing rapidly,which attracts strong attention from all walks of life.Farmers' Professional cooperatives are economic organizations that,on the basis of rural household contracting,voluntarily combine the production of agricultural products and agricultural production and operation services,and carry out democratic management and mutual assistance.Farmers'Professional cooperatives are conducive to enhancing the overall competitiveness of farmers in the market environment,safeguarding their economic interests,and farmers' cooperatives can be supported by various preferential policies and funds given by the state.It is precisely based on the many advantages of cooperatives that the number of Farmers' Professional cooperatives in China has increased sharply at this stage.Operators have established some cooperatives that do not conform to the legal provisions by taking advantage of the loopholes and weak supervision of the state's legal formulation of farmers' cooperatives.They seem to have the appearance of cooperatives,but in fact they are profitable companies and enterprises.For example:shell cooperatives,zombie cooperatives,cooperatives under the control of enterprises and so on.These cooperatives cannot obtain the corresponding economic value for farmers,but only for the purpose of national welfare as a means,and will not bring benefits and development to the country's agriculture.Farmers enter such cooperatives to produce,and ultimately lose their own interests.Therefore,how to solve the standardization of Farmers' Professional cooperatives can be said to be an important measure.Summarizing the criteria for distinguishing the authenticity of Farmers' Professional cooperatives and the shortcomings of improving the law are important ways to safeguard the interests of farmers and the development of national agriculture.China's Law on Farmers' Professional Cooperatives was amended in 2017,which is the first amendment since the enactment of the Law on Farmers' Professional Cooperatives in 2006.It can be seen that the state has paid close attention to and attached great importance to the Farmers'Professional cooperatives in recent years.For this reason,the author believes that this is the best opportunity to sum up the authenticity of Farmers' Professional cooperatives and make up for the lack of laws in China,so as to accelerate the construction of standardization of Farmers'Professional cooperatives.The first part of this paper introduces the research background,research significance,research status at home and abroad,research ideas and methods as well as the innovative points of the article.Through the above background introduction,it shows the feasibility and necessity of the standardization construction of cooperatives in China.The second part elaborates the development status,legal status and specific cases of Farmers' Professional cooperatives,and puts forward the problems that restrict the standardized development of Farmers' Professional cooperatives in China,including the lack of criteria for defining the authenticity of cooperatives,the lack of relevant laws and the inadequacy of law enforcement.The third part is to analyze the causes of the problems raised in the second part of the article,and to analyze the causes of the dilemma of the standardization of cooperatives in the light of the two university theories,legal concepts and the limitations of the law in the domestic academic circles.The fourth part is to find a way to solve the problems raised by the article on the standardization of cooperatives,including the concept of defining the true and false standards of cooperatives in China,the improvement of legal issues and the strengthening of law enforcement by law enforcement personnel,so as to promote the solution of the legal problems of the standardization of cooperatives in China.
