Since entering the 21st century,the market economy model and the wave of economic globalization are sweeping every comer of the world.The realization of democratic politics and the rule of law government has become the standard of modem government and has become a common-sense concept in peopled hearts.The birth and development of new state concepts such as the welfare state,service administration,and payment administration,the government is no longer confined to passive night watchmen who guarantee the independence and security of the country,maintain the social order,and maintain the fiscal revenue of the country's machinery.The role has gradually expanded to positive administrative and payment administrative directions such as promoting economic development,protecting the environment,providing public services,and establishing a national security system.The traditional administrative behavior is mainly due to the mandatory administrative behavior of"order obedience",and it can no longer meet the needs of the development of modern government functions.The administrative subject actively tries to use non-compulsory administrative,democratic and humane administration based on the needs of administrative management and service practice.behavior.As an important member of non-compulsory administrative actions,Administrative reward not only contain the excellent qualities of non-compulsory actions,but also have their own unique functions of guidance,incentives,and resource allocation,making Administrative reward even more popular in the public administration.Pay attention.Since the reform and opening up,administrative rewards,as one of the important means of government administration in our country,have played an important role in promoting economic development and managing the society.The implementation of specific measures such as science and technology awards,talent introduction,investment attraction,and other administrative awards have not only mobilized Administrative counterparts actively fulfilled their administrative goals,and they set a good example for scientific and technological advancement,economic and social development,and the improvement of the well-being of the people.After sorting out and studying the legislative status quo of China's administrative awards,it is not difficult to find up to the constitution and laws,down to the laws and regulations and other normative documents,will be involved in administrative awards,and the areas and scope involved are also extensive:On the other hand,China's legislation at the current stage is not perfect for administrative award-related regulations,especially the level of legislation at the central level is particularly inadequate.There is no comprehensive and detailed provision for Administrative reward,and the conditions and criteria for rewards for administrative awards and the scope of rewards The procedures for rewarding are not clear.Administrative reward need legal regulation to carry out the necessary regulations.The improvement of legislation is the precondition and basis for the good operation of the administrative incentive system.In our country,there are many deficiencies in the legislation of administrative awards,especially in the areas where the concept of administrative awards is unclear and the division of power is particularly serious.There are mainly the following problems in China's Administrative reward to create powers:the main body and the authority division of the Administrative reward for setting rights are not clear;the contents of the Administrative reward for setting rights lack legal norms;and the procedures for setting administrative awards are lacking.To improve the right to set up administrative awards in China,the first is to formulate an administrative law for administrative rewards and to rationalize the relationship between the Administrative reward;the second is to restrict the subject and authority of administrative awards,and define the scope of Administrative reward.And in the final category,the hearing system for Administrative reward was improved,and a comprehensive monitoring and supervision system for pre-and post-event administrative rewards was established and improved.All in all,the author tried to systematically study the right to set administrative awards in China,attempting to add his own opinions and opinions on the basis of existing research,and improving the theory and practice based on the combination of practical work.It will contribute its own power to the process of the legalization of China's administrative award-setting right in the future.
