Research On The Issue Of Missing Persons' Property Escrow System

Today the world is undergoing extensive and profound changes,China is also in a broad and profound period of transformation,economic,political,cultural,social,ecological and other aspects of all-round development,all-round progress.As far as the legal system of our country is concerned,the legislation is late,the foundation is relatively weak,and there are some disputes and contradictions in the judicial practice.As far as the system of missing persons in Chinese civil law is concerned,the purpose of its establishment is to protect the interests of disappeared persons and their stakeholders and to maintain public order in society.In the face of the frequent occurrence of natural disasters,the development of public transport,the increase of floating population and the increasing pressure of life,the main purpose of this paper is to study and discuss the system of missing persons in China,which leads to a sharp increase in the number of missing persons.In view of the disputes and deficiencies existing in judicial practice,this paper attempts to put forward judicial suggestions to promote the perfection and standardization of the relevant system.The first part of the article elaborates on the missing person and the property escrow system,compares and analyzes the legislation of the missing person system around the world,and then expounds the basis and value of the property escrow system of the missing person in China from the aspects of legislative significance,historical origin and rule connotation.The second part elaborates on the setting and change of the escrow of missing person's property in China.Find out the problems in the setting of property escrow and the application of changing norms,and put forward reasonable solutions.The third part mainly analyzes some disputes and disputes in the application of escrow system,such as the scope of escrow behavior,the responsibility of escrow,and the tennination of escrow.By analyzing the problems,this paper puts forward the solutions to the disputes and disputes in the areas of the scope of the escrow behavior,the responsibility of the escrow agent and the termination of the escrow.
