| The social support system is a specific collection system under China’s family planning policy,which has played a very important role in controlling the population growth of our country in the past.As the core system of China’s national policy of family planning,its main purpose is to adjust the use of natural resources and the protection of the environment,and appropriately compensate the government’s expenditure on public expenditures for social undertakings,and for citizens who do not meet the legal requirements for children.A certain amount of fees levied.However,with the development of society,it gradually appears to be incompatible with social development.In particular,the implementation of the two-child policy is a situation in which the social support system is faced with what to do.The implementation of the comprehensive two-child policy has been more than two years,and has had a profound impact on all aspects of society.In the context of the implementation of the two-child policy,whether it is the legal connection or the implementation in the actual collection process,it poses a practical challenge to the collection of social support.From the perspective of legislation,after the adoption of the Amendment to the Population and Family Planning Law,all provinces have revised their original provisions on the collection of social support.After the introduction of the two-child policy,the social support system still has shortcomings at the legislative level,and there are problems such as lack of consistency in the collection standards.It is precisely because of these exposed problems that the battle for the abolition of social support has been one after another in recent years.The collection of social support fees always circumvents the issue of reproductive rights.The core of this system is to limit the number of children born to citizens through economic measures.The essence is the restriction on reproductive rights.In this paper,the social disputes system under the two-child policy is discussed by expounding the theoretical controversy about social support and citizen reproductive rights,and the actual consideration of abolishing social support at the current stage.In addition,after the full implementation of the two-child policy,the prosecution of social support payments has become a prominent issue.From this perspective,this paper further explores the similarities and differences between the traceability mechanism of social support and the "change of principle" in the civil law and the"from the old and the light principle" in the criminal law.It is proposed that the principle of change of situation and the principle of old and light can be used to some extent to realize the flexible use in the process of collection and to reflect humanistic care.The establishment of the social support system is a powerful guarantee for the smooth implementation of family planning.However,because it is formulated in the absence of sufficient legal development conditions,there are a series of problems in the whole operation process,.which need to be fundamentally improved.Improvements to it have a wide range of issues and require stable and orderly improvements that cannot be achieved overnight.Therefore,it needs to be improved from the institutional level,including the unified collection of the main body,the regulation of the collection process,and the clear collection of objects. |
