Under the background of "ruling the country according to law",the development of "ruling by law" and "ruling by law" has gradually deepened.A good legal and regulatory system is crucial to guarantee the development of school sports.The construction of school sports laws and regulations in the mainland and Taiwan of China has experienced long-term development and is not the same due to social and historical reasons.The Taiwanese region of China pays more attention to the education legal system,and the laws and regulations related to school sports as part of education have been continuously developed and revised.The current "Advanced Senior Secondary and Junior College Five-Year System Three-Year School Physical Education Implementation Measures"(formerly "Measures for the Implementation of School Physical Education at All Levels",hereinafter referred to as "Measures"),has been revised five times by 2018.The "Regulations on School Sports Work"(hereinafter referred to as the "Regulations")in mainland China has only been a simple modification since its promulgation.At present,China is in a period of constant political and economic changes and development.There have been many new problems in the development of school sports in the past few decades.Under such a background,the "Regulations" as a special regulation for Chinese school sports work.The content is out of touch with the social reality,and certain modifications are inevitable.After five revisions,the "Measures" in Taiwan have been constantly adjusted for social changes,and the content has become more and more perfect,especially in terms of policy statutory,care for special groups,prevention of school sports safety,etc.,which deserves our in-depth study and exploration.The"Regulations" and "Measures" have a programmatic significance for the development of their respective school sports work on both sides of the strait.Therefore,this paper mainly focuses on the "Regulations" of the Chinese mainland and the "Measures" of the Taiwanese region,from the cross-strait school sports regulations.The development starts with comparing the two dimensions of the legislation and revision of the Regulations and the Measures and the main contents.Through the comparison of the two regulations,we find out the similarities and differences,and analyze the similarities and differences between the two sides of the society and concepts behind the similarities and differences.Furthermore,suggestions were made to make it possible for the revision of the "Regulations" to be useful.This paper mainly uses the literature data method,comparative research method and text analysis method.Through the combing of the development of school sports regulations on both sides of the Taiwan Straits and the comparison between the two dimensions of the Regulations and the Measures,the following conclusions are drawn.First,in the development of sports laws and regulations on cross-strait schools,the development of sports laws and regulations in cross-strait schools has experienced different historical stages.At the same time,the school sports laws and regulations have gradually improved.The "Regulations" and "Measures" are cross-strait school sports work.The special regulations;secondly,in the legislation and amendments to the "Measures" and "Regulations",the formulation of the two regulations occurred in the period of social change,but the Taiwan region paid more attention to the timely revision of the "Measures";In terms of content,the two regulations have the same and different aspects in the teaching of school sports,extracurricular sports activities,extracurricular sports training and competition,and physical education teachers.At the same time,the "Regulations" pay attention to the construction of school sports facilities.This is not in the "Measures." The "Measures" take care of the prevention of school sports safety accidents.Fourth,the difference is inseparable from the cross-strait legislative concepts,social concepts,school legal status and population base.Through the comparison between the "Regulations" and the "Measures",it is found that the "Regulations" still have some problems in the timeliness of revision,the operability of the content,and the integrity of the content.This paper believes that we should proceed from the reality of school sports,The "Regulations" make necessary adjustments and propose amendments:(1)change the concept of legislation and focus on the legalization of policies;(2)enhance the operability of the"Regulations" and timely revise them according to actual conditions;(3)attach importance to the disadvantaged groups.Protection of rights;(4)Adding school sports safety related content. |
