Research On The Public Lawyer System

In recent years,the number of public lawyers in China have increased rapidly.Up to now,there are more than 31,000 public lawyers in China.With the public lawyer team beginning to take shape,the Ministry of Justice has formulated the Management Measures for the Administration of Public Lawyers that has been implemented in January 2019.The enactment of the Measures provides a new opportunity for researching on the public lawyer system,though it is a department regulation issued unilaterally by the Ministry of Justice.The public lawyer system is an essential judicial supporting system in the process of building a government governed by law in China.Deepening the reform of the public lawyer system would be conducive to actively promoting and standardizing the work of public lawyers,and promoting the government departments to act in accordance with the law has far-reaching significance in giving imputes to the scientific and institutionalized decision-making of the government.However,although the public service lawyer system has been continuously carried out in various parts of China,it has not received due attention from the academic and practical circles in terms of its actual operation.Based on the operating mechanism of China’s public lawyer system,this paper summarizes the advantages and disadvantages regarding four types of its practice.It is not difficult to find that there are some obvious problems in the current situations of public lawyer,such as awkward legal status,conflict of business scope,unscientific management system and imperfect guarantee mechanism.Therefore,it is of great significance to take into account both theoretical construction and practical needs and combine the current situation of domestic system operation with the advanced experience of the United States,Singapore and other foreign countries,and improve the public service from the perspectives of strengthening the legal system guarantee,rationally coordinating the functions of various agencies,innovating the management system mechanism,guaranteeing the independent practice right of public service lawyers and establishing effective incentive mechanism.Hopefully this paper can provide support and reference for the reform and development of the system of public lawyers.
