An Analysis Of The Application Of My Country's Criminal Reconciliation System

On January 1,2013,China promulgated and implemented the Criminal Procedure Law,which makes a unified legal provision for the criminal reconciliation procedure of public prosecution cases,and opens a new page for the criminal reconciliation system in China.Since then,China's criminal reconciliation system has an operable theoretical basis,and the vast majority of legal workers have a more comprehensive understanding of it.The criminal reconciliation system is a special judicial system in which the parties reach a reconciliation on the basis of their own willingness and submit it it to the judicial organs for the preparation and review of the reconciliation agreement.The important significance of the implementation of criminal reconciliation system can not only protect the interests of victims,resolve civil disputes in time,but also benefit the construction of socialist harmonious society in China.After six years of judicial practice,the problems of the application of criminal reconciliation system in our country have also been exposed,such as the incomplete mechanism of criminal reconciliation participants leads to the tangible and unreal criminal reconciliation;the reconciliation system with money as the medium only leads to the wrong phenomenon of having money to buy punishment;the inadequate effectiveness of reconciliation leads to insufficient protection of the rights and interests of the parties;the supervision of criminal suspects after criminal reconciliation Poor results in poor corrective effect,lack of awareness of criminal reconciliation system among law enforcement personnel,and improper use of judicial practice.From this we can see that it is urgent to further improve the judicial system of criminal reconciliation system.This article discusses the relevant suggestions on the construction of the system of personnel assistance,multi-channel reconciliation mechanism,social correction auxiliary mechanism,and so on.Through the full realization of the effectiveness of the protection of reconciliation,we can continuously improve the level of cognition of law enforcement officers in the criminal reconciliation system.Measures and methods to make the criminal reconciliation system deeply popular will effectively apply this important judicial reform system to every suitable case.The author believes that only through the continuous improvement and optimization of the criminal reconciliation system,can it ensure its smooth operation,and make its due contribution to the reform of the judicial system and the construction of a socialist harmonious society.
