| With the continuous development of the social economy,the tourism now has become a new growth point of China’s economy.However,the ensuing tourism consumption disputes also show the trend of large-scale outbreak.When confronting the tourism consumption dispute,we can solve them through two methods: litigation and non-litigation.Through the investigation,this paper finds that litigation system has a low application rate in the actual process of dispute resolution.Both the small-scale litigation system advocated in recent years and the traditional representative litigation system have their own disadvantages in application.Therefore,this paper analyzes the feasibility of public interest litigation system in tourism consumption disputes and puts forward some suggestions on improving the public interest litigation system in solving tourism consumption disputes based on the existing problems in the current public interest litigation system.This paper takes the "investigation on the implementation of litigation settlement of tourism consumption disputes--taking the court of L district in K city as an example" as the topic to write,which consists of three parts.The first part takes the L district in K city as the research object,making a general introduction of the court’s basic situation,the acceptance of tourism consumption dispute cases and the status of lawsuit settlement.The second part finds that the current litigation system is not perfect enough to solve tourism consumption disputes through analyzing the problems confronted by the representative litigation system and small litigation system in solving tourism consumption disputes.The third part mainly researches the introduction and improvement of public interest litigation to resolve tourism consumption disputes on the basis of completing the representative litigation system and small litigation system,including demonstrating the feasibility of public interest litigation as well as the advantages of applying public interest litigation system to solve tourism consumption disputes,and finally improving the existing problems. |
