The European Union has a tradition of attaching importance to the protection of Personal Data.From the Convention for the Protection of Individuals with Regard to Automatic Processing of Personal Data to the Directive/95/46/EC of the European Parliament and of the Council to the General Data Protection Regulation,the EU has developed a comprehensive,rigorous personal data protection system,which is different from the decentralized legislative model of United States,has had a profound impact on the world.On the issue of cross-border transmission of personal data,on the one hand,a higher threshold for entry has been set,which limits the scope of external transmission of personal data in the EU to a certain extent.On the other hand,it also sets a variety of alternative transmission methods in GDPR.For countries and regions with personal data transmission needs with the EU,there are many possibilities under the premise of meeting their requirements.At present,the level of protection of personal information in China is relatively low.There are also many problems in practice.For example,frequent violations of regulations and handling of personal information by enterprises are important reasons why China cannot achieve crossborder transmission of personal data with the EU.Along with the entry into force of GDPR,Chinese companies face many potential compliance risks in conducting business in the EU,and the penalties imposed by GDPR are very strict.Once they are issued,they will bring incalculable losses to the company.However,we cannot abandon the EU market.With the promotion of China's One Belt,One Road strategy,more EU countries will join,and the EU market will further expand.The economic and trade exchanges between China and the EU will become more frequent.The crossborder transmission of personal data is the necessary tools in the business.Therefore,China should first improve the level of personal information protection in China.On this basis,we should choose the cross-border transmission method of personal data suitable for China's current situation in the EU regulations,so as to solve the crossborder problem of personal data between the two places.
