In recent years,China has corrected a number of Criminal Misjudged Cases that have aroused widespread concern throughout the country.On the one hand,misjudged cases make real prisoners go unpunished,cause innocent people endless suffering,and cause great damage to the credibility of the judiciary.Based on the sample analysis of 40 Criminal Misjudged Cases in recent years,from the perspective of "suspected crime from existence" is difficult to eradicate and how the judgement of legal facts of the case handlers under the influence of "tunnel vision" psychology deviates,so as to put forward corresponding measures to reduce the occurrence of Criminal Misjudged cases.The main body of this paper consists of five parts:The first chapter is the introduction,which mainly focuses on two issues: one is the research background and significance of the psychological causes of misjudged criminal cases in China.Criminal miscarriage occurs frequently in China,and its harmfulness has been exposed.However,scholars in China have not paid enough attention to the psychological causes of criminal miscarriage,especially the lack of research on the psychological phenomenon of "tunnel vision".Chapter 2 is a theoretical overview,which defines "tunnel vision" and "suspected crime from existence",analyses the concepts of "suspected crime" and "suspected crime from existence",sums up the basic characteristics of "tunnel vision",and briefly introduces two kinds of psychological deviation phenomena in litigation caused by "tunnel vision" Psychology-confirmatory deviation and backward-looking deviation.Chapter 3 Sample analysis of Criminal Misjudged cases.Based on the statistical analysis of 40 Criminal Misjudged Cases in China over the past 30 years,this paper summarizes the characteristics of the influence of "tunnel vision" psychology on Criminal Misjudged cases,and provides the basis for the analysis of "tunnel vision" on the identification of legal facts of case handlers.Chapter 4: Analysis of the psychological formation mechanism of "suspected crimefollowed by crime".For this part,the author first elaborates on the process of legal fact identification of the case handlers,and then the information obtained from a case sample combines with the psychological deviation caused by "tunnel vision" to elaborate how the "suspected crime from" psychology of the case handlers is generated.Chapter 5 Measures to Prevent Psychological Prejudice of "Tunnel Vision".The measures are divided into three parts.The first part is targeted education and training for case-handling personnel,and introduces two methods to overcome the "tunnel vision"-competitive hypothesis analysis and consideration of opposition law.The second part is to abolish unreasonable assessment indicators for case-handling personnel.The third part is to establish a reasonable supervision and accountability system.
