Research On The Problems And Countermeasures Of Administrative Law Enforcement In Inland Waters

General Secretary Xi Jinping pointed out in the report of the 19 th National Congress of the Communist Party of China: "Building a government ruled by law,advancing administration according to law,and strictly regulating fair and civilized law enforcement." Deepening maritime construction under the rule of law,further standardizing maritime administrative law enforcement,and improving the level of maritime administrative law enforcement are reflected in inland river maritime Administrative seriousness,strictness,rigorousness,and legitimacy;it is a requirement to regulate the order of inland water transportation,to ensure the safety of inland waters,and to prevent pollution from ships;it is a need to protect the legitimate rights and interests of inland waterway shipping companies,ship owners,and crew members;It is the need of maritime management agencies to combat corruption and uphold integrity and prevent maritime law enforcement officers from committing crimes on the job.China is one of the countries with the most rivers in the world.The waters run from east to west,from north to south,and have high shipping value.With the rapid economic development,the role of inland water transportation has become increasingly prominent.However,problems such as system irregularities,non-compliance with laws,and weak law enforcement during the development of inland navigation cannot be ignored.These problems have gradually become a stumbling block to the development of inland navigation.If not resolved in time,it will inevitably affect the maritime construction of the rule of law.Therefore,there is an urgent need to strengthen the administrative law enforcement of inland river maritime affairs.This article takes the Yangtze River as an example to study the administrative law enforcement issues of the Yangtze River,so as to provide law enforcement experience for inland maritime administrative law enforcement.The full text is divided into five parts:The first part proposes the research direction,analyzes the theoretical and practical significance of the research,and the main theories and methods to be used in the research.The second part mainly explains the concepts related to the research direction,such as inland maritime affairs(this article takes the Yangtze River with the largestinland freight volume as the research object),administrative law enforcement,etc.,and introduces the management agencies with administrative law enforcement powers in the inland river,and the unique duties of maritime administrative law enforcement.As well as the characteristics of law enforcement,the current status of inland maritime administrative law enforcement and the current innovative measures for administrative law enforcement are analyzed.The third part explores the problems and risks of the construction of inland river maritime administrative law enforcement at the top level of laws and regulations,maritime administrative behavior,the impact of administrative counterparts on administrative law enforcement,and the internal management of maritime administrations such as law enforcement equipment deployment,law enforcement team construction,and supervision system formulation And other issues.The fourth part,through comparison with domestic and foreign water management agencies such as the U.S.Coast Guard,the Japan Maritime Security Agency,the Indian Coast Guard,and the marine police with one of the domestic maritime law enforcement forces,the Marine Department of the Hong Kong Special Administrative Region Government,analyzes the value of our country.Advanced experience of inland maritime administrative law enforcement.In the fifth part,according to the aforementioned analysis,starting from the principles of lawful administration,reasonable administration,and ensuring the fairness of the procedure,it proposes a sound maritime administrative law enforcement standard system,and promotes administration from aspects of system,administrative law enforcement methods,law enforcement procedures,and administrative counterpart participation.Law enforcement effectiveness,strengthening inland maritime software and hardware construction,strengthening administrative law enforcement supervision and team building and other suggestions.
